Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Canadian Coin Heads mobile application ("the App") operated by Canadian Coin Heads ("we", "us", or "our").

1. Acceptance of Terms

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of Service

Canadian Coin Heads is a collection management application designed to help users:

• Track numismatic coin collections
• Manage precious metals (bullion) inventory
• View spot price information
• Calculate estimated melt values
• Browse reference mintage information
• Identify coins using AI-powered image recognition (optional)
• View market pricing data from third-party listing platforms
• Export and import collection data

3. User Responsibilities

You are responsible for:

• The accuracy of data you enter into the App
• Maintaining backups of your collection data
• Keeping your device secure
• Using the App in compliance with applicable laws
• All purchasing and selling decisions you make

5. Algorithmic Estimates and Data-Driven Features

The App may provide algorithmic pricing estimates, market activity indicators, probability scores, deal alerts, or other data-driven insights based on publicly available market data. These outputs are generated automatically and may be incomplete, inaccurate, or outdated. They do not constitute financial, investment, tax, trading, or professional advice. Users assume full responsibility for all purchasing and selling decisions.

6. No Guarantee of Profitability

The App is intended for collection management purposes only. We make no representations regarding potential profits, resale value, or market performance of any collectible or bullion item. Past performance of any item does not guarantee future results.

7. No Warranty of Data Accuracy

We do not guarantee the accuracy, completeness, or timeliness of:

• Spot prices for precious metals
• Mintage figures and coin specifications
• Market listing data or sold prices
• Any third-party information displayed in the App

Market conditions may change rapidly. Data displayed may be delayed, incomplete, or contain errors.

8. Third-Party Data Sources

Certain data displayed in the App may be obtained from third-party websites, APIs, or publicly available sources. We do not control or guarantee the accuracy, availability, or legality of third-party data. Third-party data sources may change or become unavailable without notice.

8a. AI-Powered Features

The App includes an optional AI coin identification feature. By using this feature:

• You consent to your coin photo being transmitted to third-party AI providers (currently Anthropic) for processing.
• AI identification results are estimates and may be inaccurate. You should verify results independently before making purchasing or selling decisions.
• You retain ownership of all photos you upload. By using AI identification, you grant us a limited license to process your photo solely for the purpose of providing the identification result.

9. Spot Prices and Valuations

The App displays spot price information for precious metals:

• Prices are fetched from third-party data providers
• Prices may be delayed and do not reflect real-time market conditions
• Calculated melt values are estimates only
• Actual market values differ based on premiums, condition, rarity, and demand
• Users may also enter prices manually

10. Data Storage and Backups

Your collection data, including photos, is stored on your device. When iCloud is enabled for Canadian Coin Heads in your device settings, this data syncs automatically across your Apple devices via Apple's CloudKit infrastructure and counts toward your iCloud storage quota. If iCloud is not enabled or is unavailable, the app operates fully in local-only mode with no data loss.

We strongly recommend:

• Regularly exporting your data using the App's export feature
• Keeping backup copies in multiple locations
• Enabling device backups through iCloud or Finder

We are not responsible for data loss due to device failure, app deletion, iCloud storage limits, or any other cause.

11. Pricing and Availability

The current release is provided as a free app. We may introduce optional paid features in a future version, but no paid plan is required to use the current core features.

12. Feature Availability

We reserve the right to modify, suspend, or discontinue any feature at any time without prior notice. Features dependent on third-party data sources may become unavailable if those sources change or are discontinued.

13. Beta and Experimental Features

Certain features may be labeled as beta or experimental. These features are provided for testing and evaluation purposes and may be modified or discontinued without notice. We make no guarantees regarding their accuracy or reliability.

14. Limitation of Liability

To the maximum extent permitted by law:

• The App is provided "as is" without warranties of any kind, express or implied
• We are not liable for any indirect, incidental, special, or consequential damages
• We are not liable for any loss of data, profits, or business opportunities
• We are not liable for investment losses, trading losses, or lost profits arising from reliance on pricing or market data
• Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim

15. Indemnification

You agree to indemnify and hold harmless Canadian Coin Heads and its affiliates from any claims, damages, or expenses arising from your use of the App, your reliance on any data or features provided by the App, or your violation of these Terms.

16. Intellectual Property

The App and its original content, features, and functionality are protected by copyright, trademark, and other intellectual property laws.

17. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes through the App or our website. Continued use of the App after changes constitutes acceptance of the new Terms.

18. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or us.

19. Dispute Resolution

If a dispute arises out of or relates to these Terms or the App, the parties agree to first attempt to resolve the dispute informally by contacting us at [email protected]. If the dispute is not resolved within 30 days, either party may pursue resolution through the courts of the Province of Manitoba, Canada.

20. Age Restriction

The App is not directed at children under the age of 13. By using the App, you represent that you are at least 13 years of age.

21. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Manitoba and the federal laws of Canada applicable therein, without regard to conflict of law provisions. Any legal proceedings shall be brought in the courts located in the Province of Manitoba.

22. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

23. Apple App Store Terms

If you downloaded the App from the Apple App Store, you also agree to Apple's standard EULA terms. In the event of a conflict between these Terms and Apple's terms, Apple's terms will govern to the extent required.
